RAFA Benalmádena – Welfare Equipment

Padron

Have You Been Padronned?

If you live permanently in Spain or own property here, then you should be on the empadronamiento of your local municipality. If I appear to be preaching to the converted, then I apologize, but there are still a lot of people out there who are suspicious that registering on the padron will result in the Spanish Government chasing them for taxes. This could not be further from the truth. In fact it is nothing more than a census of people living in the municipality, costs nothing to register and has benefits for both yourself and the ayuntamiento. In my own municipality simply being on the padron gets a discount on the IBI (Council Tax). If this is coupled with payment on time and by direct debit the discount is 30%. For pensioners there can also be discounts on travel and other local facilities.

The Town Hall also receives a grant from the Regional Government commensurate with the number of people registered. So, the more people there are registered, the more money they receive, the better the services they can provide. The next time you feel like complaining about the lack of police, poor street cleaning, and graffiti etc. then ask yourself if you are registered. If not go ahead and do it.

There can also be other longer-term benefits. The 2007 "Ley de Dependencia" (Law of Dependency) details what assistance is available to vulnerable groups, including the elderly, who can no longer look after themselves and who do not have available funds to pay for care. To qualify for assistance, be it home help or residential care, the person must gave held a certificate of residence for 5 years and have been on the padron for 5 years. Admittedly, even when these criteria are met it can still take 12 to 18 months before the service can be delivered. This time period may also depend on where you live and what demand there is on the local Social Welfare services. Unfortunately no one can foresee that in 18 months they may need this level of assistance. But it is a start and a far cry from the days when the family were expected to meet all these needs.

Finally, if you hold a certificate of residence and are on the empadronamiento you will be eligible to vote in the local and European elections.

So, If you are not registered, I would urge you to do it and tell all your friends as well. You can pick up the paperwork from your Town Hall.

E121 Replacement

Replacement for the Form E121

Those of you who were affected by the EHIC changes last month may be aware that the EU social security regulations have been updated and that the changes came into force on 1st May 2010. As part of this update, it is important to note that 'E-forms' (for example the E121) have been replaced with new forms and they are now going to be known by different names.

One of the most relevant name changes that British citizens living in Spain should be aware of is to the forms used to access healthcare abroad. The E121, which is available to UK State Pensioners and their dependants, and the E106, available to posted workers and in some cases early retirees, have now both been replaced by the S1. As with the E121 and E106, the S1 must be registered with the Spanish authorities to give the holder access to full healthcare and the form comes with full Instructions on how to do so.

PLEASE NOTE: Anybody who is already registered under an E121 or E106 does not need to take any action as their E121/E106 remains valid and their entitlement to healthcare is not affected. These changes only apply to new applicants who will receive an S1 instead of the E121/E106.

Preserved Forces Pensions

If you left the forces before April 1975 and unless you had served 22 years, you were not entitled to receive a pension.

These rules were changed in April 1975 so that if you left the service after that date and had served for at least five years and were over the age of 25, you became entitled to an inflation proof pension payable when you reached the age of 60, plus a terminal grant of 3 times the annual pension. Those with 12 years service received a pension of over £300 a month plus about £12,000 terminal grant.

I personally missed that date by about 18 months and I have heard of those who missed it by a few days. Indeed there were many servicemen who would have qualified for a pension but were "encouraged" by the MoD to end their service early, by a matter of a few months, without being made aware of the impending rule changes. The MoD obviously wanted to avoid paying the pensions.

There are currently two groups lobbying to have the rules applied to all those who ended their service prior to April 1975. These are Combined Armed Forces Federation UK www.caffuk.org.uk and Armed Forces Pension Group www.afpg.info

If you left the service prior to 1975 without receiving a pension I would urge you to take a look at these websites and perhaps sign up to their campaign, it will cost you less than £40 per year and if their fight on your behalf is successful then you may receive a lot more than that in return.
